This Privacy Policy describes how your personal information is collected, used, and shared with/by Seeing You Home Incorporated (the “Corporation”) when you visit http://www.seeingyouhome.ca/ (the “Website”), and any affiliated webpages.

The purpose of the Website is to gather market information for and to promote the business of Seeing You Home Incorporated (the “Business”), and anything affiliated thereof.

We reserve the right, at our sole discretion, to update, change or replace any part of the Privacy Policy by posting updates and changes to the Website. a. We collect personal data which may include but not be limited to, name, title, job, industry, current address, postal/zip code, telephone number, fax number, email, etc. (“Personal Data”).

All Personal Data is provided by you directly when you sign up for our email newsletter.

b. We collect technical data including but not limited to, device use, web browser, IP address, metrics, personal websites, corporate information and logs (“Technical Data”).

Through use of the Website, you are granting us explicit permission to track your Technical Data through any method as long as it is in compliance with the laws of the Province of Ontario and Canadian Federal law, including but not limited to:

We do not share any specific Personal Data with third parties, however we may share aggregated Personal Data with third parties. Through the continued use of the Website, you consent to all Technical Data being shared with third parties.

Through the continued use of the Website, you also consent to us sharing your Personal Data and Technical Data in order to comply with applicable laws and regulations, including but not limited to, being compelled to produce any kind of data to a court of competent jurisdiction.

Through the continued use of the Website, you also consent to us sharing your Personal Data and Technical Data with any of our service providers (ie. database management, marketing provider, internet service provider) for the purposes of better servicing the Business.

4. Newsletter

The Business operates an email newsletter program, used to inform subscribers about listings and other products/services offered by the Business. Users can subscribe through the Website, email link, or any other method available through the Business or an affiliate. Users provide Personal Data at their own discretion, and consent to the use of said Personal Data as is otherwise outlined in this Privacy Policy.

All Personal Data relating to subscriptions are held securely and in accordance with the Canada Personal Information protection and Electronic Documents Act (PIPEDA). Should you require a record of any Personal Data held through the Website or Business, you may request it through correspondence on the Website or via email, however a small administrative fee may be payable upon production of the Personal Data, as a processing fee.

Email newsletters delivered through the Website or in the course of the Business, may contain tracking tools within the actual email. Said activity may be stored on a server or other device for analytic use relating to the Business and optimizing of future newsletters. Tracked activities may include, but not be limited to, reader behavior regarding engagement, opening patterns of attached URL’s, viewing frequency, dates, and times, as well as anything else not in contravention of PIPEDA or any other relevant legislation.

Subscribers may unsubscribe at any time through an automated system, of which a URL will be posted at the bottom of the newsletter.

5. Third Party Links

Third-party advertisements and links on the Website may direct you to third-party websites that are not affiliated with the Website. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites or advertisements.

6. Limitation of Liability

In no case shall Seeing You Home Incorporated, its principals, shareholders, directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from any unintended breach or disclosure of Personal Data or Technical Data to any third party or publicly, or for any other claim related in any way to any unintended breach or disclosure of your Personal Data or Technical Data, including, but not limited to, any errors or omissions in the Corporation’s/Business’s security measures, firewalls, encryption, or other data protection measures, or any loss or damage of any kind incurred as a result of the unintended breach or disclosure of your Personal Data or Technical Data thereof, resulting in Personal Data or Technical Data being leaked, posted, transmitted, hacked, stolen, made available publicly or to any third-parties in any form, or being exploited in any way.

7. Severability

Each provision of the Privacy Policy shall constitute a separate and distinct clause and shall be severable from all other such separate and distinct clauses contained in the Privacy Policy. If any provision of the Privacy Policy as applied to any party or to any circumstance shall be adjudged by a court of competent jurisdiction to be invalid or unenforceable, the same shall, as to that jurisdiction, be ineffective to the extent of the invalidity or unenforceability and shall be severed from the balance of this Privacy Policy and shall in no way affect any other provision of this Privacy Policy, the application of such provision in any other circumstances or jurisdiction, or the validity or enforceability of this Privacy Policy.
